ITR-3 or ITR-4 for freelancers: which ITR, and is this foreign income?
Short answer
- Presumptive income (44ADA), total income up to ₹50 lakh, no foreign assets: ITR-4.
- Books of account, any money held abroad (Wise or Payoneer balance), director, unlisted shares, crypto or losses to carry forward: ITR-3.
- This covers FY 2025-26 returns (filed in 2026). For FY 2026-27, 44ADA becomes Section 58.
FY 2026-27 note: from 1 April 2026 the Income-tax Act, 2025 applies and 44ADA is Section 58. Returns for FY 2026-27 are filed in 2027; the form names for that year had not been notified when we checked on 17 Oct 2026. What changes
Which ITR fits your situation?
| Situation (FY 2025-26) | Likely form |
|---|---|
| Presumptive 44ADA, paid via PayPal India, Skydo or direct SWIFT, income up to ₹50 lakh | ITR-4 |
| Any money held in Payoneer, Wise, a foreign bank or brokerage during the year | ITR-3 (Schedule FA) |
| You keep books and declare actual profit | ITR-3 |
| Total income above ₹50 lakh | ITR-3 |
| Crypto gains, director, unlisted shares, losses to carry forward | ITR-3 |
| Salary plus presumptive freelancing, otherwise eligible | ITR-4 |
Rule 164 bars ITR-4 if you hold assets or have signing authority in an account outside India, have income from a source outside India, are a company director, held unlisted shares, or have losses to carry forward. ITR-4 has no Schedule FA or FSI. See Payoneer, PayPal, Wise in ITR.
Questions
Can I file ITR-4 if I use Payoneer, PayPal or Wise?
PayPal India, Skydo and direct SWIFT credit rupees to your Indian bank, so they don't by themselves create a foreign asset. A balance held in Payoneer or Wise is an account outside India, and Rule 164 bars ITR-4 if you hold assets or have signing authority in an account outside India.
Does a zero-balance Wise account need Schedule FA?
No official FAQ settles this. The cautious approach many CAs take is to report the account in Schedule FA, which means ITR-3. Ask your CA.
Is foreign client income 'income from outside India'?
When you do the work in India, the fee is generally your Indian professional income, not foreign-source income for Schedule FSI. Edge cases exist, such as work done while abroad.
Which ITR form for a freelancer with salary plus freelancing?
If the freelance income is presumptive, total income is up to ₹50 lakh and nothing else rules it out, ITR-4. Otherwise ITR-3.
What changes for FY 2026-27?
From 1 April 2026 the Income-tax Act, 2025 applies. 44ADA becomes Section 58 with the same 50% rate and limits. Returns for FY 2025-26 (filed in 2026) still use the 1961 Act and 44ADA. Form names for FY 2026-27 returns had not been notified when we checked.
